Our regulatory framework

We regulate cemetery and crematorium operators that provide burial and cremation services in NSW.

Our vision is that all people in NSW have access to sustainable and affordable burial and cremation services that are respectful of culture and faith and provided in a consistent, transparent and accountable manner.

The regulatory framework describes our approach

The Cemeteries & Crematoria NSW Regulatory Framework (PDF, 8.1 MB) explains how we will regulate the industry. It aims to deliver 3 key outcomes:

  • All people in NSW can access sustainable and affordable burial and cremation services of their choice that are appropriate to culture and faith. People also have access to consistent information to help them make informed decisions.
  • Operators provide interment services in keeping with the Cemeteries and Crematoria Act 2013 and Cemeteries and Crematoria Regulation 2022. Operators must show integrity, transparency, consistency, affordability, respect and accountability.
  • Crown cemetery and crematorium operators are supported to run their business activities to the standards set out in the Act. Crown operators lead by example in governance, regulatory compliance, sustainability and service delivery.

In our regulatory decisions we consider a risk-based approach based on the potential harm to the industry and community.

Being a successful regulator depends on strong relationships with all stakeholders. We work with our stakeholders to achieve a sound regulatory environment for a strong and sustainable industry for the benefit of all citizens in NSW.

Interment Industry Scheme

To make sure people in NSW have access to sustainable, affordable and dignified burial and cremation (interment) services, the NSW Government has introduced the Interment Industry Scheme – a licensing system for cemetery and crematorium operators. The Regulations governing the scheme commenced on 14 October 2022.
